1. Pursuant to the provisions of reference (a). Subject, hereinafter
referred to as Petitioner, filed enclosure (1) with this Board
requesting, in effect, that the applicable naval record be corrected
to reflect that Petitioner served in the Reserve Component for.service
segment 2 May 1986 through 30 November 1993.

2. The Board, consisting of eee
reviewed Petitioner's allegations of error an njustice on

20 January 2015 and, pursuant to its regulations, determined that the
corrective action indicated below should be taken on the available
evidence of record. Documentary material considered by the Board
consisted of the enclosures, naval records, and applicable statutes,
regulations and policies.

3, The Board, having reviewed all the facts of record pertaining to
Petitioner’s allegations of error and injustice, finds as follows:

a. Before applying to this Board, Petitioner exhausted all
administrative remedies available under existing law and regulations
within the Department of the Navy.

b. In correspondence attached as enclosure (2}, the office
having cognizance over the subject matter addressed in Petitioner’s

warrants favorable action.
CONCLUSION

Upon review and consideration of all the evidence of record, and
especially in light of the contents of enclosure (2), the Board finds
the existence of an injustice warranting the following corrective
action.

RECOMMENDATION:

That Petitioner’s naval record be corrected, where appropriate, to
show that:

a. The record of military processing - Armed Forces of the
Unites States (DD Form 1966), executed on or about 26 March 1986, is
modified to read SERVICE PROCESSING FOR “DNV’ (Reserve) vice “DNR”.
(Regular).

b. Paragraph B8a (FOR ENLISTMENT IN A DELAYED ENTRY / ENLISTMENT
PROGRAM (DEP)) of the DD Form 4/1, executed on or about 26 March 1986,
ig modified to remove all responses. Furthermore, DD Form 4/3 is:
removed.. -

c. The 4 year immediate reenlistment contract (NAVPERS
1070/601), executed on or about 12 July 1991, is modified to read
“Naval Reserve" vice “United States Navy”, BR/CL “USNR” vice “USN”,
and RADO MONTHS/DAYS “948/000", vice 000/000".

a. Petitioner executed a 24 month agreement to extend enlistment
(NAVPERS 1070/621), operative on or about 12 July 1995, which is
modified to read “Naval Reserve” vice “United States Navy”, and BR/CL
“USNR” vice “USN”. , :

e, Block 2 (DEPARTMENT, COMPONENT AND BRANCH) of the DD Form 214
executed on or about 30 November 1993 is modified to read “NAVY -
USNR" vice "NAVY - USN".

f. The record of discharge from the U.S. Naval Reserve
(Inactive) (NAVPERS 1070/615), effective 30 November 1996, is null and
void.

g. Note: PERS-91 will change his record to reflect that
Petitioner served in the Reserve Component for service segment 2 May
1986 through 30 November 1993; transfer him to the Retired Reserve,
without pay, effective 1 November 1996; and assist him in applying for
non-regular service retirement at age 60 (16 August 2011).

h. A copy of this Report of Proceedings will be filed in
Petitioner's naval record.

5. Pursuant to the delegation of authority set out in Section 6(e)
of the revised Procedures of the Board for Correction of Naval Records
(32 Code of Federal Regulations, Section 723.6(e)) and having assured -
compliance with its provisions, it is hereby announced that the
foreaoing corrective action, taken under the authority of reference
(a), has been approved by the Board on behalf of the Secretary of the

Navy.
